1. Both these petitions challenge the same impugned arbitral award dated 11th January 2016 passed by the learned Arbitrator in terms of which it was determined that the amount payable by Bharat Heavy Electricals Limited ('BHEL') to the Claimant, i.e., Offshore Infrastructures Limited ('OIL') was
Rs. 86,47,106.
2. It is submitted on behalf of OIL that the entire claim amount is much higher than what was awarded amount and the learned Arbitrator has erroneously directed the parties to share the withheld payment equally. BHEL is also unhappy with the Award to the extent that it has held it liable to make payment to POIL and has also rejected its counter-claims.
3. In that view of the matter, the impugned Award dated 11th January 2016 passed by the learned Arbitrator is set aside. It is clarified that the parties are at liberty to proceed afresh with the arbitration in accordance with law.
4. The petitions are disposed of in the above terms. S.MURALIDHAR, J OCTOBER 19, 2016 Rm
