O R D E R

% 02.05.2017 CM No.11240/2017 This is an application on behalf of the petitioners seeking to place on record the Settlement Agreement dated 16.09.2016, whereby, the disputes between the petitioner and the respondent No.3 have been settled.

The petitioners have filed the present petition impugning the order dated 28.01.2016, whereby, the Registrar of Copyrights - Respondent No.2 held the respondent No.3 as the copyright owner in Software (Literary Work) titled "Vetport-A Veterinary Clinic and Hospital Management Software".

By the Settlement Agreement, the petitioners have agreed to WP(C) 3893/2016

purchase half share in the copyright owned by the respondent No.3 for valuable consideration.

It is confirmed by the petitioners and the respondent No.3 that the petitioners have performed their part of the agreement and, accordingly, 50% rights in the copyright stands transferred to the petitioners.

I have examined the terms of the Settlement Agreement dated 16.09.2016 and finds the same to be lawful.

The Settlement Agreement is taken on record.

Learned counsel for the petitioners and learned counsel for the respondent No.3 submit that they shall be approaching the respondent No.2 for registering the joint ownership of the petitioners and the respondent No.3.

Learned counsel appearing for the respondent Nos.1 and 2 submits that as and when such an application is received, the same shall be considered in accordance with law.

In view of the above, the application is disposed of. W.P.(C) 3893/2016 & CM Nos.16522/2016 (stay), 26328/2016 (stay) In view of the settlement between the petitioners and the respondent No.3, as recorded in the Settlement Agreement dated 16.09.2016 and the orders passed in CM No.11240/2017, the writ petition is disposed of.
