Learned APP accepts notice for respondent no. 1.

Respondent no. 2 is present in Court along with her counsel and has been identified by ASI Azad Singh of police station Mangol Puri. Respondent no. 2 also accepts notice.

Respondent no. 2 submits that she has settled the matter with petitioner of her own free will, voluntarily and without any undue force, pressure or coercion in pending case bearing HMA No.150/2014 on 12th January, 2015 by the Family Court, Rohini Courts, Delhi. Joint statement of petitioner and respondent no.2 recorded by the trial court has been placed on record at pages 30 to 31.

Respondent no.2 says that her marriage with petitioner has already been dissolved by a decree of divorce by mutual consent dated 15th November, 2016 passed by the Family Courts, North West Distric, Rohini Courts, Delhi and she has no objection in case FIR No.1866/2014 under sections 354/506/509 IPC registered at police station

Mangol Puri, is quashed.

Keeping in mind the facts and circumstances as detailed above, more particularly, the fact that marriage of petitioner and respondent no. 2 has already been dissolved by a decree of divorce by mutual consent, in the interest of justice, the aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
