% 11.01.2016 I.A.403/2016 (Under Order 23 Rule 3 CPC) This application seeks disposal of the suit in terms of the Memorandum of Understanding arrived at between the parties on 30th December, 2015. The application has been signed by the parties as well as their counsel and is supported by the affidavits of the parties. Although the plaintiff has sought 37.5% share in the suit property, nevertheless, she has settled for 26%. The Terms of the Memorandum of Understanding are lawful. The application is accordingly allowed.
CS(OS) 2328/2014 In terms of the order passed in I.A. 403/2016, no lis survives between the parties. The learned counsel for the parties submit upon instructions from the parties who are present in the Court, that the
parties shall abide by the terms of the Memorandum of Understanding whereby 26% share of the plaintiff in the suit property bearing No. 25/77, West Punjabi Bagh, New Delhi, shall be protected in all circumstances. Their assurance is taken on record. The suit is disposed off in the above terms. Let decree sheet be drawn up in terms of the Memorandum of Understanding.
