O R D E R

% 25.05.2018 CM 22355/2018 (u/O. 23 R. 3 CPC) Both parties have come up with this joint application under Order XXIII Rule 3 CPC, inter alia, stating that they have settled the matter amicably.

The application is supported by their respective affidavits. In terms of the said affidavit, the respondent has handed over to the petitioner a demand draft in the sum of Rs.5,00,000/-, copy whereof has already been submitted with the application. The petitioner in terms of the said settlement has agreed to vacate the demised premises handing over its vacant and peaceful possession to the respondent forthwith. He undertakes to abide by the terms of the said settlement in letter and spirit.

Binding both parties with the above said compromise, the RC.REV. 229/2016

revision petition and the applications filed therewith are dismissed as withdrawn, as prayed.

The next date of hearing i.e. 17.07.2018 as earlier fixed, stands cancelled.
