versus GOVT. OF NCT OF DELHI & ORS ..... Respondents Through:

CORAM:

HON'BLE MR. JUSTICE VALMIKI J. MEHTA

O R D E R

% 23.01.2017 1.

Counsel appearing for respondent nos. 1 to 4 states that the impugned recruitment rules passed in the 16th Meeting of the Council for Academic Affairs held on 27.1.2016 and 42nd Meeting of the Board of Governors held on 5.2.2016 alongwith the notification dated 1.4.2016 have since been superseded by a subsequent notification dated 6.6.2016, as per which there will be no direct recruitment to the post of Chief Security Officer and the Chief Security Officer will be appointed by promotion as was the position W.P.(C) 4196/2016

prior to the impugned notification dated 1.4.2016. It is also stated that now as and when a vacancy arises for the post of Chief Security Officer, petitioner alongwith other eligible candidates will be considered for promotion in accordance with law.

2.

In view of the above statement made on behalf of counsel for the respondent nos.1 to 4, since effectively the reliefs prayed for in the writ petition would stand allowed, and therefore, the writ petition as such would become infructuous as entitlement of the petitioner is only to be considered for promotion to the post as per the earlier recruitment rules, and which are now applicable, this writ petition is accordingly disposed of, leaving the parties to bear their own costs.
