% 28.02.2017 The decretal amount is less than two crores rupees. Learned counsel for the decree holder submits that there is an interest awarded which is accrued more than Rs 2 Crores. Though, the submission made by counsel for the decree holder is not plausible. As per Section 4 of Delhi High Court (Amendment) Act 2015 (Act 23 of 2015) which came into effect from 26.10.2015 vide notification No. F. No L-19015/04/2012 Jus dated 26.10.2015 and extracts of the minutes dated 20.10.2016, the execution petition is liable to be transferred before the concerned District Court.
Learned counsel for the decree holder submits that address of the decree holder is falls within the jurisdiction of New Delhi District, as such let the matter be sent matter before the Learned District & Session Judge (New Delhi District), Patiala House Court.
In view of the submission and circumstances, let the matter be sent to the Ld District & Session Judge (New Delhi District), Patiala House Court.
Parties be directed to appear before the Court of Ld District & Session Judge (New Delhi District), Patiala House Court on 28.04.2017.
