The present writ petition under Article 226 of the constitution of India read with Section 482 Cr.P.C. has been been filed by the petitioner praying for issuance of directions to respondents No.1 and 2 to provide protection to him from respondents No.3 to 5.

Notice. Learned ASC accepts notice on behalf of State/R-1 and R-2. 3.

Status report has been filed by the State/R-1 to the following effect:- 'On 04.04.2016 complainant Satyabhan Singh Baghel S/o Sh.Rameshwar Singh R/o RZ-F-293, Nihal Vihar, Delhi-41 gave a complaint in which he stated that his wife Rachana is living with her parent's house and on 14.02.16 when he went to her parent's house, his father in law Ramdass and his brother in law Bhawesh quarrelled with him and took his bike. Enquiry was conducted in the complaint and it was found that the W.P.(CRL) 1240/2016

complainant had disputed with his wife Rachana and she is now living at her parent's house. When he went to her house, he quarrelled with them and left his bike that was given by her parents at the time of marriage. She stated that she will file a complaint in CAW Cell also. Local enquiry reveals that it is a matrimonial dispute.'

Mr.Rahul Mehra, learned Standing Counsel for the State submits that though from the local enquiry, as per the status report, it appears to be a matrimonial dispute but still to ensure the petitioner about his safety, mobile numbers of concerned SHO/Beat Constable of the area shall be provided to the petitioner to enable him to contact the police if necessity arises. 4.

In view of the aforesaid assurance given by learned Standing Counsel for the State/R-1, learned counsel for the petitioner seeks leave to withdraw the present petition.

Accordingly, the writ petition is dismissed as withdrawn. As prayed, copy of the order be given dasti to learned counsel for the parties.
