% 03.01.2017 On 22.04.2016 notice was issued to the respondent. Notice could not be served as the process fee was not filed. Thereafter, on 08.12.2016 again notice was issued to the respondent returnable for today. Dasti notice was also directed to be served through the counsel appearing for the respondent before the trial court. Again, the process fee was returned under objection and notice could not be served.
The learned counsel for the petitioner submits that eviction order has already been executed and the respondent has got possession of the property itself and she seeks an adjournment.
In the light of the above facts, it is manifest that the petitioner is not interested in prosecuting the present petition any more. The same is dismissed for non-prosecution.
