1. This is an application under Order XXIII Rule 3 CPC for recording the terms of the settlement as set out in the Memorandum of Understanding ('MoU') dated 2nd November 2015 signed by the parties, a copy of which is enclosed with the application. The application is supported by the affidavit of the Plaintiff and the power of attorney of the Defendant.

3. It is confirmed that the Defendant has withdrawn the divorce petition filed in Texas, USA against the Plaintiff. Further it is stated that the payments in terms of the MoU have been received by the Plaintiff.

4. The MOU shall bind the parties. The MoU is taken on record and shall form part of the present order.

5. The application is allowed.
