CORAM:

HON'BLE MR. JUSTICE MANMOHAN

O R D E R

% 25.04.2016 Present writ petition has been filed seeking a direction to respondents to abandon the plan of construction of rooms/buildings in the Government (Coed) Sunder Nagari, School ID No. 1106264. Learned counsel for the petitioner states that the construction of additional rooms/building would deplete the playground and therefore is contrary to the provisions of Delhi School Education Act 1973. He further states that construction of additional rooms/building would be detrimental to the healthy atmosphere of the School as construction of a new four storied building in front of a two storied building would create hindrance in light and fresh air to the students of the two storied building.

It has been averred in the petition that respondent no. 1GNCTD vide letter dated 3rd March, 2016 directed the School‟s Principal to handover the site for carrying out the construction of additional rooms/building, without any planning and/or consultation with the School Management Committee.

Learned counsel for the petitioner states that the petitioner made a representation dated 14th March, 2016 to respondent nos. 1 & 2, but no reply has been received till date.

Consequently, the present writ petition is disposed of with a direction to respondent no.2 to decide the petitioner‟s representation dated 14th March, 2016, which are annexed at pages 39 & 40 of the paper book, within a period of two weeks after giving an opportunity of hearing to one of the members of the petitioner. The reasoned order shall be communicated to the petitioner by registered AD post. With the aforesaid direction, the present writ petition and the application are disposed of.
