The learned counsel appearing for the parties state that the controversy involved in the present petition is identical to the one decided in ARB.P. 337/2018 and the order passed in that matter is also determinative of the present petition.

Thus, for the reasons stated in ARB.P. 337/2018 captioned "Vasathi Housing Limited v. Indiabulls Distribution Services Limited", the present petition is dismissed leaving it open for the parties to invoke the arbitration clause under the Escrow Agreement in accordance with law, if necessary.
