% 07.12.2018 I.A. 16733/2018 Present application has been filed on behalf of the plaintiff-applicant seeking refund of the Court-fees.

The Settlement Agreement dated 21st September, 2015 contained a clause that Court-fee levied by the plaintiff in the matter shall be refunded as per rules. The suit of the plaintiff-applicant was disposed of with a direction that, "The parties shall be bound by the terms and conditions of the Settlement".

Keeping in view the aforesaid, the present application is allowed and the Registry is directed to issue to the plaintiff a certificate authorising him to receive back from the Collector full amount of the Court-fee paid by him in the present suit.
