% 17.05.2016 None has appeared for the petitioner. Learned counsel for the respondent submits that the possession of the suit property has since been delivered to him pursuant to an execution petition which he had filed before the Executing Court. This was on 10.12.2015. The user charge which has been fixed as an interim measure had not been paid by the tenant. The interim order had accordingly been vacated on 29.10.2015. It was pursuant thereto that the possession had been effected in favour of the landlord/non-applicant. Learned counsel for the non-applicant/respondent submits that thisi petition has become infructuous.

Since none has appeared for the petitioner, petition is dismissed in default as also for non prosecution.
