% 25.04.2016 Having heard learned counsel for the petitioner, we are not inclined, at this stage, to interfere or modify the order dated 14th October, 2015 passed by the Central Administrative Tribunal, Principal Bench, New Delhi. The basic grievance of the petitioner is the delay in disposal of the application for seeking modification or vacation of the interim order. It is pointed out that the petitioner was impleaded as a party to the OA No. 3671/2015 vide order dated 29th February, 2016 and some hearings have

already taken place. It is further pointed out that the matter is now fixed before the tribunal on 26th April, 2016, i.e., tomorrow. It will be open to the petitioner to point out urgency and argue the matter before the tribunal. Learned counsel for the respondent submits and states that he would not take adjournment before the tribunal and are ready and eager to argue the matter.

Taking the said statements on record, we dispose of the present writ petition at this stage. As noticed above, learned counsel for the petitioner has pointed out that there is some urgency in the matter. The tribunal may examine the said contention. We clarify that we have no expressed any opinion on merits.

Copy of this order will be given dasti to the learned counsel for the parties under signature of the Court Master.
