Learned counsel for the petitioner submitted that in terms of the settlement arrived at between the parties, an amount of Rs.12 lacs was deposited with the Registrar General of this Court and the same may be released in favour of the respondent No.1 provided that the respondent No.1 withdraws the petition under Section 138 of the Negotiable Instruments Act, 1881 (NI Act) which is pending before the Trial Court.

Learned counsel for the respondent No.1 also submitted that the amount of Rs.12 lacs is lying deposited with the Registrar General of this Court may be released in favour of the respondent No.1 and the respondent No.1, after the receipt of the aforesaid amount, shall withdraw the petition under Section 138 of the NI Act pending before the Trial Court.

The statements of the learned counsels for the parties are accepted and are taken on record.

The amount of Rs.12 lacs lying deposited with the Registrar General of this Court along with interest, if any, be released in favour of the respondent No.1 as per rules, on moving an appropriate application by the respondent No.1. The respondent No.1, after the receipt of the aforesaid amount, shall withdraw the petition under Section 138 of the NI Act pending before the Trial Court on the next date of hearing fixed before the Trial Court. 5.

Learned counsel for the petitioner, in view of the aforesaid directions of this Court, submitted that he may be allowed to withdraw the present petition. Accordingly, the petition is dismissed as withdrawn. Pending applications are also dismissed as withdrawn. Parties shall remain bound by the above-said terms and conditions. Dasti.
