% 03.08.2016 By the present petition, the petitioner seeks to impugn the order dated 16.03.2016 on the limited issue of imposition of costs of Rs.10,000/-. perusal of the impugned order shows that defendant No.2/petitioner was served on 06.05.2015 and that the application for condonation of delay in filing the written statement was filed on 15.09.2015. Further the impugned order records that the learned counsel for the plaintiff/respondent for expediting the matter fairly stated that the delay in filing the written statement of the petitioner/defendant No.2 be condoned subject to heavy costs. The trial court accordingly imposed a cost of Rs.10,000/- on defendant No.2/petitioner to permit filling of the written statement.

There is no reason to interfere with the impugned order. Accordingly, CM(M) 734/2016 Page | 1

the present petition is dismissed.
