This is an application (CM. No.30629/2018) supported by the signed Settlement Deed entered into between the parties on 10.5.2018. It has been agreed that appellant will deliver possession of the suit premises to the respondents and the respondents will not press any case which is filed against the appellant, of course this Court however observes that the said statement of the respondents is inter se the parties inasmuch as question of quashing of criminal cases would be decided by the appropriate court where criminal cases are pending in accordance with law. 2.
The present application is signed by the parties and supported
by their affidavits and therefore the application satisfies the requirements of Order 23 Rule 3 CPC.

The amount deposited in this Court by the appellant will be released by the Registry of this Court to the respondent no.1 in terms of clause H of the Settlement Deed alongwith accrued interest. Payment be made to the respondent no.1 by the Registry within four weeks from today. 4.
Application is allowed and the appeal is disposed of in terms of the Settlement Deed entered into between the parties. Parties will be bound by the terms of the Settlement Deed.
