This hearing has been done through hybrid mode. 2.

The present appeal under Section 96 read with Order XLI Rule 1 of the CPC, seeks the following prayer: - "It is, therefore, prayed that the Hon'ble Court may kindly be pleased to set aside the judgment dated 05.05.2010 passed by Shri Dinesh Bhatt, ADJ, Delhi in, suit No.37/08, thereby dismiss the suit of the respondent and consequently allow the counter claim of the appellants."

Vide order dated 18.04.2012 passed by the learned Predecessor Bench, the impugned judgment and decree dated 05.05.2010 was stayed on the condition of appellants depositing the decretal amount in this Court. It is a matter of record that no such amount was deposited. 4.

There was no appearance on behalf of the appellants on 06.12.2025 and accordingly Court notice was issued to them. Report with regard to the said Court notice reflects that the same could not be served as the address was not traceable.
