O R D E R

% 04.07.2018 The applicant was arrested on 15.01.2018 statedly on the basis of disclosure of co-accused Manoj Kumar during investigation of FIR No. 09/2018 under Sections 392/411/34 IPC of police station New Friends Colony.

The offence in the case is stated to have taken place sometime around 01:45 hours on 14.01.2018. The auto rickshaw of the first informant along with certain other items were robbed during the incident. The auto rickshaw is stated to have been recovered from co-accused Manoj Kumar. It is the case of the State that the registration certificate of the auto rickshaw was recovered from the possession of the applicant. There is no previous involvement of the accused in the crime.

In the facts and circumstances, the application is allowed. He is directed to be released on bail subject to the following conditions:- (i).

The petitioner shall furnish personal bond in the sum of Rs.25,000/- with one surety in like amount to the satisfaction of the BAIL APPLN. 1041/2018

trial court.

(ii).

Prior to his release, he shall give the telephone numbers of self and of at least one other responsible family member besides that of the surety to the trial court.

(iii) He shall scrupulously appear at each and every stage of the proceedings before the trial court so as not to cause any obstruction or delay to its progress.

(iv).

He shall not commit an offence similar to the offence of which he is accused of or the commission of which he is suspected. (v).

He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence; and (vi).

He shall not leave India without the previous permission of the trial court.

The bail application is disposed of in these terms. This also disposes of pending applications.

A copy of this order shall be transmitted to the jail authorities and to the trial court. Dasti.
