Mediation settlement agreement signed by the parties has been placed on record. The counsel affirm and state that the parties will be bound by the said settlement.

In terms of the aforesaid settlement agreement, petitioner has handed over five post dated cheques for a sum of Rs.6,66,000/- and one cheque for a sum of Rs. 6,70,000/-.

Rs.7,00,000/- along with interest accrued thereon, if any, will be released to the Cooperative Society.

On encashment of the said cheques, all proceedings emanating from the award dated 16.07.2003 will be treated as disposed of as settled. No

further amount or payment would be payable under the award dated 16.07.2003. Parties are bound and would abide by the mediation settlement dated 5th December, 2016.

However, if cheques are dishonoured the execution proceedings shall continue from the stage they were pending and the settlement agreement will be treated as cancelled/void.
