% 13.07.2015 We have heard the learned counsel for the parties. The appeal is dismissed subject to the fact that the costs be reduced from Rs 30,000/- to Rs 10,000/- insofar as the appellant (defendant No. 2) is concerned.

The costs be paid to the plaintiff through counsel within four weeks from today. In case the costs are paid, the written statement of the appellant / defendant No. 2 be taken on record. The appeal is dismissed as above.
