On the last date of hearing, insofar as of the summoning of the concerned official at (iii) of para 10 along with the record of a case pending in relation to FIR No.63/2013 dated March 15, 2013 registered in PS Bani Park, Jaipur City (South), Jaipur, Rajasthan is concerned, it was stated by learned counsel for the petitioner that certified copy of the record has been applied but the same was not given as the investigations are still on. The Court had directed the counsel to file an affidavit. The affidavit has been filed and it is now being clarified by the learned counsel for the petitioner, till the filing of the charge sheet, the parties are not allowed to apply for certified copy, as the investigations are on. In other words, the petitioner

had not applied for certified copy of the relevant record. 2.

He draws my attention to para 4 of the affidavit, wherein the petitioner has specified the reasons for which the relevant record in terms of (iii) of para 10 of the petition is sought for. 3.

Noting the contents of the affidavit, petition and the order of the Tribunal, let summons be issued to the concerned official of the court of Additional Civil Judge (JD) and City Magistrate-17, Jaipur City, Rajasthan for his appearance before the learned Arbitrator Justice R.C. Jain (Retd.) on May 14, 2016 at 11.00 AM at Conference Hall of Holiday Club, Panchsheel Enclave, New Delhi along with the record of FIR No. 63/2013 dated March 15, 2013 registered in P.S. Bani Park, Jaipur City (South), Jaipur, Rajasthan. Petition is disposed of.
