% 25.05.2016 Present writ petition has been filed seeking a direction to respondent no. 2 to release the payment disbursed by the government under crop compensation scheme.
It is the case of the petitioners that petitioners had inherited land in respect of which compensation is being sought under a gift deed executed by their father-in-law. The said gift deed has been challenged by respondent no. 4 by way of a civil suit.
Learned counsel for petitioner states that respondent nos. 3 and 4 have filed a complaint with respondent no. 2 due to which no compensation has been released to the petitioners.
This Court is of the opinion that till the civil court decides the matter, compensation cannot be released to the petitioners. If compensation is
released earlier, then respondent no. 2 shall run the risk of being involved in a family litigation.
Consequently, present writ petition is disposed of with a direction to respondent no. 2 to deposit the crop compensation that is payable against the land in question within eight weeks in CS (OS) 1941/2015 pending before this Court.
The money shall be disbursed only after the civil court has decided the aforesaid civil suit.
With the aforesaid directions, present writ petition and application stand disposed of.
