% 22.01.2018 After some hearing, the learned counsel for the respondent fairly concedes the impugned order may be set aside and leave to contest may be granted to the petitioner. He, however, submits that given the old age of the landlord (the respondent), the Rent Controller may be asked to expedite the proceedings.
The impugned order dated 23.01.2016 declining leave to contest to the petitioner (the tenant) and passing an eviction order in favour of the respondent (the landlord) is set aside. The application of the petitioner for leave to contest stands granted. The proceedings before the Rent Controller shall stand revived. The parties are directed to appear before the said forum on 16th February, 2018. The petitioner will be obliged to submit his written statement before the Rent Controller on the date of first appearance before the Rent Controller. Given the old age of the landlord/respondent, this
Court hopes and trusts that the Rent Controller shall expedite the proceedings and take a decision on an early date. This disposes of the revision petition and the pending application.
