Vide proceedings dated 26.07.2018, it had already been observed to the effect : - "4. Today's adjournment is granted subject to payment of costs of Rs.15,000/- by the appellant / decree-holder to the counsel for the respondents. If the cost is not paid, the appeal shall be liable to be dismissed for non-prosecution." and thus in terms of the order dated 26.07.2018, the EX. F.A. 35/2012 is thus dismissed for non-prosecution.
