Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') has been filed on behalf of the Petitioners for quashing of FIR No.
283/2017 under Section 323/341/354/354B/506/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Karawal Nagar, New Delhi and the proceedings emanating therefrom, in terms of the Settlement dated 26.03.2024.

On advance Notice, learned APP on behalf of the State has appeared and accepts Notice.

On a specific query being put to the Complainant, who is aged about 60 years, submits that they had function in their family on account of retirement party of her brother-in-law, which was held in nearby premises at about 12:00 midnight. When they started going home and taking their remaining food items, the Petitioners raised an objection and overturned their drinking utensils, hit her chest and torn her clothes. An altercation took place wherein she is physically assaulted in which she received some scratches. On a specific query of their being sexual molestation, she has stated that it was only a case of physical assault. 6.
The Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Compromise Deed/Memorandum of Settlement dated 26.03.2024. 7.
Today, the Respondent No. 2 is present in the Court, states that she has no objection if the said FIR is quashed.

The Statement of the parties have already been recorded before the learned Joint Registrar. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 283/2017 under Section 323/341/354/354B/506/34 of IPC registered at Police Station Karawal Nagar, New Delhi and all the consequential proceedings emanating therefrom are quashed. However, the Petitioners and the Respondent No. 2 are directed to deposit of cost of Rs.10,000/- each with the Delhi High Court Advocates' Welfare Trust, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
within 7 days failing which the matter be put up before the learned Registrar General, for the recovery of the said cost.
