The plaintiff had instituted this suit for partition of property No.D-88, Kirti Nagar, New Delhi constructed over land ad-measuring 200 sq. yds. 2.
The suit was entertained and written statement was filed by the defendant.

The parties were, vide order dated 27th July, 2016, referred to the Mediation Cell of this Court.

The disputes subject matter of suit between the parties are informed to have been settled with the efforts of Ms. Pusshp Gupta, Advocate / Mediator and a Settlement Agreement dated 27th September, 2016 purported to be signed by the parties, their counsels and the Mediator has been received from the Mediation Cell of this Court.

The counsel for the plaintiff and the counsel for the defendant support the Settlement Agreement and state that the suit be decreed in terms thereof. 6.
I have perused the Settlement Agreement.

The settlement as contained therein is found to be lawful and is allowed.

In view of the said Settlement Agreement, a preliminary decree for partition is passed declaring the plaintiff and the defendant to be owners in equal share of property No.D-88, Kirti Nagar, New Delhi. 9.
Decree sheet be drawn up.

In view of the Settlement Agreement, a final decree for partition of the property by sale thereof and distribution of sale proceeds between the parties as per their respective shares declared in the preliminary decree and with liberty to the plaintiff to buy the 50% share of the defendant and in terms of the Settlement Agreement, is also passed, leaving the parties to bear their own costs.
