O R D E R

1. The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996, inter alia, praying that an arbitrator be appointed to adjudicate the disputes that have arisen between the parties in relation to a tripartite agreement dated 30.12.2011.

2. The learned counsel appearing for the respondents has no objection if an independent arbitrator is appointed to conduct arbitration under the aegis of Delhi International Arbitration Centre (DIAC). Accordingly, with the consent of the parties, Mr Gautam Narayan, Advocate is appointed as the sole arbitrator to adjudicate the disputes between the parties. This is subject to the necessary disclosure being made under Section 12 of the Act and the arbitrator meeting the eligibility criteria under Section 12(5) of the Act. The parties shall appear before the Co-ordinator, DIAC on 22.05.2017 at 11:00 AM. The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules.
