% 20.09.2018 Mr. Sharma, who, appears for the respondent, says that there is no dispute that an arbitration agreement exists between the parties, though, the respondent has much to say on the merits of the case. In these circumstances, Mr. Sharma cannot but argue that an Arbitrator would have to be appointed.

Accordingly, Mr.D.S. Paweriya, (former Additional District and Sessions Judge) (Mobile No.9810433390) is appointed as an Arbitrator in the matter. Counsel also agree that the fee of the learned Arbitrator will be paid in terms of fourth Schedule appended to the Arbitration and Conciliation Act, 1996. It is ordered accordingly.
