Mr. Singh has entered appearance on behalf of the respondent. He says that he does not wish to file a reply.

Counsel for the respondent says that there is a possibility of parties reaching a settlement and, therefore, they should be referred to the Delhi High Court Mediation and Conciliation Centre (in short 'Centre'). 3.

Learned counsel for the petitioner says that she has no objection to the matter being referred to the Centre for attempting a settlement in the matter. 4.

Accordingly, the petition is disposed of with the following directions: (i) Mr. Ashish Dholakia, Mobile No.9811157597, is appointed as an Arbitrator in the matter.

(ii) The learned Arbitrator will not enter upon reference till 30.9.2018 to give parties a chance to arrive at a mediated settlement. (iii) Parties and their counsel will appear before the Centre on 17.8.2018 at 3.00 p.m.

(iv) In case the parties are unable to arrive at a settlement, the ARB.P. 383/2018

Arbitrator shall enter upon reference and decide the disputes on merits. (v) In the event parties are able to arrive at a settlement before the Mediator, the Mediator will furnish his report to the Court. The Registry will then place the matter before the Court.

(vi) Parties are given liberty to move an appropriate application in that behalf, so that the matter can be listed in Court. 5.

Parties are agreed that if the matter is adjudicated upon by the learned Arbitrator, the rules and the fee prescribed by the DIAC shall govern the arbitration proceedings.
