CORAM:

HON'BLE MR. JUSTICE S.P.GARG

% 04.01.2017 1.

The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.432/2013 registered under Sections 302/182 IPC. Status report is on record.

2.

I have heard the learned counsel for the parties and have examined the file. It is urged that the petitioner is in custody since 01.09.2013. She has been granted interim bail many a times and there are no allegations of its misuse. The petitioner has a minor daughter to take care of.

All the material prosecution witnesses have been examined. Learned APP urged that there are serious allegations of murder of mother-in-law against the petitioner. 3.

I have considered the submissions and have examined the Trial Court record.

All the material prosecution witnesses have been examined. The trial is at its fag end. The allegations against the BAIL APPLN. 870/2016

petitioner are that she committed murder of her mother-in-law. It is relevant to note that as per the prosecution, the petitioner herself was informant and had given false information about the commission of murder of her mother-in-law by someone else. Subsequently, it was found that it was the petitioner who had committed the crime. 4.

The petitioner has been granted interim bail on several occasions for treatment of illness i.e. T.B. she is purportedly suffering from.

5.

Considering the gravity of the offence and the serious allegations against the petitioner, no sufficient ground for grant of regular bail at this stage and it is dismissed. 6.

Trial Court record be sent back immediately with the copy of the order through 'Special Messenger'.
