The appeal is argued at length.

The suit filed by the appellant/plaintiff as also the appeal is clearly frivolous. The suit is barred not only because it is beyond the period of one year limitation, of the first limitation coming to an end in the year 2006 and the second limitation coming to an end on 7.2.2014, but also that there cannot be a suit filed that a defendant in his defence was unsuccessful in the earlier suits and thereafter compensation as damages be granted to the successful plaintiff.

I was inclined to dismiss the appeal with exemplary costs, however, counsel for the appellant has taken instructions from the appellant that the appeal be disposed of as not pressed. 3.

Accordingly, the appeal is disposed of as not pressed, subject to RFA 632/2018

the appellant depositing a sum of Rs.5,000/- as costs positively within two weeks from today with the website www.bharatkeveer.gov.in, and receipt thereto be filed within one week thereafter. 4.
