% 27.02.2017 (1) The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.367/2016 under Sections 3/4/5 Delhi Public Gambling Act, 1955;
Section 420/120B IPC;
Section Information Technology Act, 2000 registered at Police Station Janak Puri. Status report is on record.
(2) I have heard the learned counsel for the parties and have examined the file. By an order dated 25.04.2016, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has since joined the BAIL APPLN. 826/2016
investigation.
(3) Petitioner's involvement emerged in the disclosure statement of co-accused Rahul who informed that the premises in question were taken on rent by the petitioner and his brother Pramod Gupta. The petitioner was not arrested at the spot and no incriminating material was recovered from his possession.
(4) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `50,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.
(5) The bail application stands disposed of.
