Ordinarily I would not have jurisdiction to decide the present suit as this Court does not have pecuniary jurisdiction in view of the Office Order dated 24.11.2015 issued by Hon'ble the Chief Justice in exercise of powers conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015, however, since the suit has been compromised, I exercise my powers under Section 24 CPC read with Article 227 of the Constitution of India for passing the present order.

In this suit for specific performance parties have entered into a written settlement agreement before the Delhi High Court Mediation and Conciliation Centre on 28.10.2015.

The written settlement agreement

signed by the parties falls within the scope of Order 23 Rule 3 CPC and, therefore, this suit is disposed of as per the terms as stated in the settlement agreement dated 28.10.2015.

The Suit is accordingly disposed of and settlement agreement dated 28.10.2015 will form part of the decree. Parties are left to bear their own costs.
