The Petition under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.P.C.') has been filed on behalf of the Petitioner, Mr. Pulkit Sharma, for quashing of FIR No. 13/2011 under Sections 198A/406/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Keshav Puram and the subsequent proceedings emanating therefrom.

The Petition has been signed by the Petitioner and is supported along with the Affidavit of the Petitioner, as well as, the Respondent No. 2/Mrs. Neha Sharma and has endorsed the contents of the Petition and has specifically mentioned that she has amicably settled the present matter and does not want to pursue the FIR No. 13/2011 and has no objection if the aforesaid FIR and the subsequent proceedings emanating therefrom, are quashed by the Court.

The Memorandum of Understanding (MOU)/Agreement is dated 17.03.2018. The Respondent No. 2 had appeared in person on 21.01.2019 and has accepted the Notice. She has now again been served through her father but has failed to appear.

Learned counsel on behalf of the Petitioner submits that the Appeal against the divorce decree has already been withdrawn. The proceedings under Protection of Women from Domestic Violence Act, 2005, are pending but the Respondent No. 2 is not appearing in the said proceedings as well. 5.

Considering that the parties have amicably settled all their disputes vide MOU/Compromise Deed dated 17.03.2018, nothing more survives in the present FIR especially when the Petition is supported by the Affidavit of the Respondent No. 2, who has endorsed the Compromise Deed dated 17.03.2018.

In view of the Compromise Deed, the present FIR No. 13/2011 under Sections 198A/406/34 of the IPC, registered at Police Station Keshav Puram and the subsequent proceedings emanating therefrom, are quashed. The settlement is without prejudice to the rights of the child, Master Krishav. 7.

The Petition is disposed of accordingly.
