O R D E R

% 25.07.2016 Learned senior counsel for the petitioners submits that petitioners were working as Guards, when complainant/injured tried to climb the gate and trespass the property.

In the process he fell down and sustained injuries.

Petitioners did not beat him and have been falsely implicated. Learned APP for State submits that complainant/injured has specifically stated that on 7th April, 2016 at about 11:15 pm he had gone to see his plot at Y Block near Shiv Mandir, when petitioners gave beatings to him with dandas.

It is submitted that the injured has sustained compound fracture in his right leg, he was operated and plates have been fixed in his leg. It is submitted that doctor has opined the injury as 'grievous', caused by a blunt object.

Keeping in mind the totality of the circumstances, I am of the view that petitioners are not entitled to anticipatory bail. Bail application is dismissed.
