/2016 (u/O XXIII, Rule 3 CPC to be numbered by the Registry) & O.M.P.No.124/2014 and EX.P. 191/2013, E.A. Nos.501/2013 & 369/2014 Both the parties have resolved the disputes. Today the parties have handed over the present joint application under Order XXIII Rule 3 read

with Section 151 CPC, for recording the terms and conditions of the settlement and passing an appropriate order.

The Registry is directed to number the same.

The terms and conditions of the settlement are recorded in paras 3 of the application. The application is duly signed by the parties as well as their respective counsel. The same is also supported by the affidavits of both the parties along with the resolution for settling the matter. The parties shall be bound by the terms and conditions of the settlement. Judgment-debtor has handed over a cheque of Rs.5 lacs in the name of decree-holder. Other post dated cheques have also been issued by the judgment-debtor who has ensured that the cheques if presented in time, will be encashed. Accordingly, the abovementioned petition as well as execution petition are disposed of.

No order as to costs.
