1. The minor daughter of the Petitioner is present in Court. She is at present housed at the Catalyst Critical Care Centre. She has informed Mr. Rahul Mehra, learned standing counsel for the State that she wishes to return to her mother. The mother of the Petitioner is also present in Court and has undertaken that she will take good care of her daughter, if she wishes to return home and there will be no cause of concern.

2. It appears that the next date in the trial Court which is the Court of Ms. Nivedita Anil Sharma, learned Additional Sessions Judge-01 (West), Tis Hazari Courts, Special Court of the POCSO Act is on 20th August, 2018 for cross-examination of the victim girl to resume.

3. The Court is of the view that the very purpose of day to day of trial as mandated by the POCSO Act would be defeated if such a long date is given for resumption of cross-examination of the victim. The Court directs that the next date of cross-examination of the victim should be advanced in the fourth week of July, 2018 preferably in between 25th July, 2018 and 31st July, 2018. For this purpose, the Court directs that the New Sessions Case No. 56156/2016 be listed for directions before the aforementioned Court on 21st July 2018 for fixing a date as directed by this Court. The further crossexamination of the victim should be attempted to be completed on the date fixed by the trial Court for that purpose.

If there is any difficulty in the implementation of the above directions and if the victim girl is in any distress hereafter for any reason, it will be open to the Petitioner or even the victim girl to approach this Court for directions. Meanwhile, the SHO concerned will be in regular contact with both the Petitioner and the victim girl to ensure that the victim girl is taken care of well with no cause for concern. Liberty is also granted to SHO to move this Court for directions, if the need so arises.

5. The petition is disposed of in the above terms.

6. A copy of this order be given dasti under the signatures of Court Master.
