CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 02.08.2018 It is submitted that petitioner (husband) and respondent no. 2 (wife) have settled their disputes amicably vide compromise/settlement deed dated 20th April, 2018, inasmuch as they are living together, therefore, FIR No.755/2015 under Sections 498-A/406 IPC, PS K.N.Katju Marg and the consequent proceedings emanating therefrom may be quashed. Respondent No.2 is present in Court along with her counsel. She has been identified by ASI Yogdutt Sharma of P.S. K.N.Katju Marg. Respondent no. 2 submits that she has settled the matter with petitioner of her own free will and without any undue force, pressure or coercion and is that she is now living with him.
She says that presently she has no
grievance against the petitioner and has no objection in case aforesaid FIR is quashed.
Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
