CRL.M.C. 2620/2018 1.

Petitioner seeks quashing of FIR No.1285/2016 under Section 135 Indian Electricity Act, Police Station Mehrauli. 2.

Subject FIR was registered, consequent to a raid conducted at the premises of the petitioner and direct theft of electricity was found. Bill for theft of electricity in the sum of Rs.1,59,623/- was raised. 3.

On petitioner approaching the respondent No.2, the said Bill amount CRL.M.C.2620/2018

was settled for Rs.83,306.64. The total amount of Rs.83,306.64 has been paid and No Dues Certificate has been issued to the petitioner on 12.02.2018.

Authorized Representative of Respondent No.2/BSES Rajdhani Power Limited is present in Court in person.

He confirms that the parties have arrived at a Settlement and settlement amount has been received by respondent No.2 and further submits that they have no objection for the quashing of the subject FIR.

In view of the above and keeping in view of the fact that the matter has been settled between the parties and the settlement amount of Rs.83,306.64 has been paid and No Dues Certificate has been issued to the petitioner on 12.02.2018 and further respondent No.2 does not wish to press its complaint, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from. 6.

Accordingly, FIR No.1285/2016 under Section Indian Electricity Act, Police Station Mehrauli, and the consequent proceedings emanating there from are hereby quashed.
