The petitioners seek quashing of FIR No. 97 of 2018 under Sections 323/341/34 of the IPC Police Station Paschim Vihar, New Delhi, based on a settlement. Subsequently, on receipt of the MLC Section 325 of the IPC was also added.

The subject FIR was registered after a quarrel which took place between friends and colleagues studying in the same college. 3.

The parties are present in person in Court. It is contended that the parties have settled their disputes and the settlement agreement dated 18.04.2018 has been executed.

Both the parties are present in person in Court today, represented by their counsel and are identified by the Investigating Officer. They submit that they have settled the disputes with the intervention of friends and family. Respondent No. 2 to 4 submit that they do not wish to press the criminal complaint against the petitioners any further.

In view of the fact that the petitioners as well as respondents are students and were friends and claim to be still continuing as friends and also keeping in view that they are in the dawn of their careers and that the disputes between the parties has been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom. 6.

In view of the above, the petitions are allowed. FIR No. 97 of 2018 under Sections 323/341/34 of the IPC Police Station Paschim Vihar, New Delhi and the consequent proceedings emanating therefrom are, accordingly quashed.
