% 03.08.2016 Both the parties are present in person along with their respective counsel. The undertaking of the petitioner has been recorded in court. The petitioner has undertaken today in court to vacate the suit premises/shop in question on or before 27.10.2017. He has filed an affidavit to this effect.

Keeping in view the statement and the affidavit of the petitioner, the present petition is disposed of binding the petitioner to his undertaking including his undertaking to vacate the suit property on or before 27.10.2017.

In view of the above, the learned counsel for the respondent states that the respondent will not take any coercive steps till 27.10.2017. JAYANT NATH, J.

I have signed the affidavit dated 02.08.2016 at point 'A' and 'B'. I have been explained the contents of the affidavit in Hindi language by my counsel. I undertake to vacate the tenanted premises/ shop in question on or before 27.10.2017.

I undertake to pay all the dues regarding electricity and water till the date of vacation. I also undertake to pay unpaid rent @ Rs.130/- per month w.e.f. October, 2012 till vacation.

I undertake to the court to abide by the order passed by the court today.
