HON'BLE MR. JUSTICE ASHUTOSH KUMAR

O R D E R

% 30.09.2015 The petitioner seeks anticipatory bail in connection with FIR No.190/2013 (PS Malviya Nagar) instituted for offence under Sections 498A/406/34 of the IPC.

It has been submitted that with the effort of mediators, the dispute between the husband and wife has been settled. The settlement agreement has been brought on record whereby the parties have agreed to adhere to the time schedule for withdrawing the cases lodged by each of them against the

other party and they are also required to expedite and facilitate the conclusion of the divorce case which has been filed by mutual consent. Considering the aforementioned facts, the interim protection granted to the petitioner by order dated 20.03.2015 is made absolute. In the event of his arrest, the petitioner would be enlarged on bail on his furnishing a bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the arresting officer/SHO of the concerned police station.

Learned counsel for the petitioner submits that considering the fact that petitioner was ordinarily residing in USA and was off and on coming to this country, a LOC against him was issued by the concerned authority. Let no coercive action be taken against the petitioner pursuant to such a look out circular.

Application is disposed of accordingly.
