CORAM:

HON'BLE MR. JUSTICE PURUSHAINDRA KUMAR KAURAV

% 12.09.2024 1.

The instant writ petition was dismissed vide order dated 06.12.2018 while imposing a cost of Rs.25,000/- to be deposited by the petitioner before the Registrar General of this Court.

2.

The matter was, thereafter, directed for compliance of the aforesaid order.

3.

The order sheets, thereafter, indicate that various directions were issued, including directions for the personal appearance of the counsel who represented the writ petitioner and the Advocate who verified the petitioner before the Oath Commissioner. However, all those directions were of no avail to trace the petitioner.

4.

Even the Police was also directed to place on record the Status Report and despite the issuance of a non-bailable warrant, the petitioner could not The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. be located.

5.

The report of the Deputy Commissioner of Police dated 14.03.2023 indicates that no whereabouts of the petitioner were found and therefore, the non-bailable warrant remained unexecuted.

6.

Having noted the aforesaid circumstances, the Court also takes into consideration the statement made by Mr.Yashvir Singh, Advocate who is present in person and he submits that even he has been unable to locate the petitioner despite his best efforts.

7.

The Court, therefore, finds that continuing the present writ petition on its Board may possibly serve no useful purpose. 8.

Unfortunately, the Court only observes that the remedy under Article 226 of the Constitution of India has been grossly misused by the petitioner. 9.

Having said so, nothing more can be done at this stage and accordingly, the instant proceedings stand closed. 10.

Since the non-bailable warrants also have not been executed in the absence of the whereabouts of the petitioner, therefore, the same stand cancelled.

11.

The instant petition stands disposed of alongwith the pending applications.
