% 03.06.2016 The present is a petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) praying for a direction to the Competent Authority to escort the petitioner in custody parole to the Pakistan High Commission at New Delhi, in order to enable him to collect his passport.
Learned counsel appearing on behalf of the DRI states that they do not wish to file a reply to the present petition since they do not oppose the custody parole sought for by the petitioner.
Since the respondent No.2/DRI does not oppose the present petition, the prayers made therein are allowed. The Superintendent, Central Jail, Tihar is directed to escort the petitioner in custody to Pakistan High Commission, after fixing a date with the concerned officer of Pakistan High Commission at New Delhi. The petitioner shall be escorted safely to Pakistan High Commission at New Delhi and returned to the jail on the same day. With the above directions, the writ petition is allowed and disposed of accordingly.
A copy of this order be sent to the Jail Superintendent, Tihar for necessary compliance and for onward communication of the same to the petitioner.
