By this petition, the petitioner seeks modification of orders dated 24th January, 2018 and 28th November, 2017 granting him furlough stating that the petitioner is not in a position to furnish the conditions imposed by the order of Court. The petitioner was granted 1st spell of furlough by the competent authority for a period of three weeks vide order dated 28th November, 2017 directing him to furnish two surety bonds for a sum of ₹ 10,000/- to the satisfaction of Superintendent, Central Jail No. 13, Mandoli. Since the petitioner could not furnish the said surety bond he moved an application for modification of the surety bond which was also allowed on 24th January, 2018 directing release of the petitioner on his furnishing a personal bond in the sum of ₹10,000 with one surety bond of the like amount.

By the present petition, the petitioner seeks further modification of the said order on the ground that he is not in a position to furnish the said surety. 3.
Petitioner prays that he be permitted to furnish personal bond and deposit cash surety in lieu of surety bond.

A status report has been handed over which is taken on record. As per the status report the appellant has been convicted for murdering his wife and the parents also. The witnesses in the case are the near relatives. As per the verification the house of the petitioner i.e. H.No. 234-A, Gali No. 9, Raj Nagar, Palam Colony, Delhi is in very bad condition and locked since last 9 years. Thus no family member of the petitioner is ready to stand surety for the petitioner.

Considering the conduct of the petitioner this Court is of the view that the condition imposed for grant of 1st spell of furlough vide the order dated 28th November, 2017 passed by the competent authority duly modified on 24th January, 2018 cannot be further modified. 6.
Petition is dismissed.

A copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
