O R D E R

% 27.05.2016 Learned counsel appearing on behalf of the petitioner seeks leave to withdraw this bail application with liberty to institute fresh proceedings in accordance with law, once the two eye witnesses in the subject case are examined before the Trial Court.

A perusal of the order dated 08.03.2016, whereby the applicant's prayer for regular bail was rejected by the Trial Court, reveals that the application filed on his behalf was dismissed, inter alia, on the ground that material witnesses had not yet been examined in the case.

In view of the foregoing, leave and liberty as prayed for is granted. Application is disposed of accordingly.

However, the statement of IO in the subject FIR, SI Madan Mohan, PS Parliament Street, to the effect that the two eye witnesses in this case shall be produced before the Trial Court for examination on the next date of hearing i.e. 30.05.2016, is hereby accepted by this Court.
