% 03.12.2018 On the last date of hearing, last and final opportunity was granted to the plaintiff to obtain permission from the Himachal Pradesh High Court to proceed ahead with the present proceedings. No such permission has been obtained.

Admittedly, the Liquidator had been appointed with respect to the defendant-company on 6th January, 2017. Since the plaintiff had sufficient time to obtain permission from the Himachal Pradesh High Court - which he has failed to do till date - present suit is disposed of with liberty to plaintiff to pursue his claim in the appropriate forum. Any original document filed by the plaintiff be returned to the counsel for the plaintiff after retaining a certified copy of the same.

The plaintiff is permitted to recover the court fee deposited in this Court as part of its claim.
