Jagdish Vishnoi And ORS. v. Registrar Of Companies And ORS.
$~68 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(C) 4581/2018 JAGDISH VISHNOI AND ORS.
..... Petitioners Through:
Mr Varun Kashyap and Ms Yogita Bhatia, Advocates.
versus REGISTRAR OF COMPANIES AND ORS.
..... Respondents Through:
Mr Dev P. Bhardwaj, CGSC for UOI with Ms Akanksha Mishra, Advocate for UOI.
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 14.09.2018 C.M. No.37765/2018 1.
The petitioners have filed the present application, inter alia, praying for extension of time for depositing a sum of `1,15,000/- in the form of fixed deposit receipt (FDR) with the Registry of this Court. 2.
In terms of the order dated 04.05.2018, the petitioners were required to deposit the FDR on or before 15.05.2018. The said order was passed as the petitioners desired to avail the Condonation of Delay Scheme 2018, which was to expire on 31.03.2018. The said Scheme was extended till 01.05.2018. The petitioners had approached this Court just prior to expiry of the extended term of the said Scheme and, therefore, were granted the opportunity to file the requisite fee in the form an FDR before 15.05.2018.
3.
The Condonation of Delay Scheme 2018 is now no longer open. Thus, the delay cannot be condoned. Even otherwise this Court finds the explanation for the delay - internal disputes between the Directors of the company in question (Fortune Nidhi Limited) - unpersuasive. 4.
In view of the above, the application is dismissed. VIBHU BAKHRU, J SEPTEMBER 14, 2018 MK
